  • Lead trial counsel for general contractor in $15 million dispute with subcontractor for termination for default
  • Lead trial counsel for electrical subcontractor against DC WASA for equitable adjustment claims in excess of $5 million
  • Lead trial counsel for design professional in defending multi-million dollar error and omission litigation
  • Lead trial and appellate counsel for contractor in bid protest dispute before the Virginia Supreme Court
  • Lead trial counsel for mechanical subcontractor and surety in defending $15 million construction performance and delay dispute related to work at Dulles Airport
  • Lead trial and appellate counsel for contractor in overturning termination for default and successful recovery of claims for equitable adjustment against the State of Maryland
  • Lead trial counsel for excavation contractor in successful recovery of multi-million dollar claims involving defective specifications, delays, disruption, lost productivity and differing site conditions
  • Lead trial counsel for developer defending multi-million dollar mechanic’s lien claims by Subcontractors and related termination for default against general contractor

  • Represented contractor against United States Department of Agriculture in overturning a termination for default
  • Represented several contractors in bid protest and injunctive relief proceedings before boards of contract appeals, county, state and federal levels
  • Represented several subcontractors and suppliers in performance and payment bond disputes

CONTRACTING AND TRANSACTIONAL

  • Routinely negotiates and prepares all types of construction contracts between owner, engineer, contractor, subcontractor and supplier clients
  • Regularly counsels construction contractors relating to all varieties of construction projects with a common focus on how to minimize the risk of litigation
  • Routinely prepares EPC construction contracts for major energy infrastructure construction companies
  • Lead outside counsel for $860 million general construction contract for large-scale electric transmission project
  • Lead outside counsel for multi-national construction material distribution agreement

OF NOTE

  • Prior to attending law school, Seth worked as a surveyor while in college and after college he worked for a large construction contractor and has parlayed that experience into a successful construction law practice.
